Terms of Service

These terms define how Black Sky Diesel provides diesel repair services and online store transactions, including customer responsibilities and legal conditions.

1) Acceptance of Terms

These Terms of Service govern your use of blackskydiesel.ca, our online store, and repair/service interactions with Black Sky Diesel. By accessing our site, placing an order, requesting a quote, booking service, or authorizing work, you agree to these terms.

If you do not agree to these terms, do not use our website or services.

2) Scope of Services

  • Diesel repair, diagnostics, maintenance, and performance-related service work.
  • Parts and merchandise sales through our online store and direct channels.
  • Related customer workflows such as estimates, approvals, invoices, support, and warranty handling.

3) Account and Information Accuracy

You are responsible for maintaining accurate account, contact, vehicle, and billing information. You are also responsible for activities under your account credentials and for protecting account access.

4) Estimates, Quotes, and Work Authorization

  • Estimates and quotes are based on information available at the time and may change if additional issues are identified during inspection or repair.
  • No repair or installation work is authorized until approved by you or your authorized representative.
  • Additional work discovered during repair requires updated authorization unless immediate action is reasonably required for safety or damage prevention.
  • Quoted timelines are estimates and may change based on diagnostics, parts availability, workload, supplier delays, and external factors.
  • Where parts must be ordered, Black Sky Diesel will communicate expected timelines but is not responsible for supplier or carrier delays.

5) Orders, Pricing, and Availability

  • Prices, taxes, shipping, and fees are shown at checkout or in written service documentation.
  • Inventory and lead times can change without notice.
  • We may cancel or refuse orders where there are pricing errors, fraud concerns, supplier constraints, or legal/regulatory issues.
  • Special-order, electrical, opened, used, installed, custom-fabricated, or non-returnable items may be final sale.

6) Payment Terms and Interest

Payment terms are as stated on your invoice, estimate, checkout flow, or approved credit arrangement. Past-due balances accrue interest at a rate of 29% per annum, calculated daily, from the date of the invoice until the balance is paid in full. Past-due balances may also result in delayed release of goods, paused work, service refusal, or lawful collection activity. You are responsible for applicable taxes and processing fees where disclosed.

7) Cancellations, Returns, and Refunds

Return and cancellation eligibility depends on item type, condition, supplier policy, and whether work has begun or parts were specially ordered. Approved returns may be subject to restocking, shipping, inspection, and processing deductions. Contact support before returning any item.

Work already completed or in progress is billable regardless of cancellation. Parts ordered on your behalf that cannot be returned to the supplier are non-refundable.

8) Shipping and Delivery

Shipping timelines are estimates, not guarantees. Risk of loss or delay transfers according to applicable carrier terms and law. You are responsible for ensuring accurate shipping details and for promptly reporting damaged or missing deliveries.

9) Vehicle Owner Responsibilities

  • You confirm authority to approve services for the vehicle/equipment presented.
  • You agree to disclose known vehicle issues, prior modifications, and operating concerns that may affect diagnostics or repair outcomes.
  • You are responsible for legal compliance related to vehicle use, emissions, equipment configuration, and roadworthiness in your jurisdiction.
  • We may decline work that we determine is unsafe, non-compliant, or contrary to law/policy.

10) Test Drives and Operational Testing

By authorizing service, you grant Black Sky Diesel permission to operate and road-test your vehicle as reasonably necessary for the purpose of diagnosis, quality assurance, and post-repair verification. Black Sky Diesel will exercise reasonable care during any test drive but is not responsible for pre-existing mechanical conditions that manifest during testing.

11) Risk of Loss

While Black Sky Diesel exercises reasonable care over vehicles left in our possession, the customer bears the risk of loss due to theft, fire, weather, vandalism, or other events beyond our reasonable control. We recommend maintaining comprehensive insurance on your vehicle at all times.

12) Warranty and Disclaimers

Any warranty provided by Black Sky Diesel is limited to the terms expressly stated in writing. Manufacturer and supplier warranties, if any, are subject to their own terms. Except as required by law, services and products are provided as-is and as-available without implied warranties of uninterrupted operation or fitness beyond stated warranty coverage.

13) Storage and Abandoned Vehicles

A vehicle must be collected within 3 business days of notification that service is complete. Storage fees of $50 per day will apply beginning on the 4th business day after notification. Vehicles left uncollected for more than 30 days after notification will be considered abandoned and may be dealt with in accordance with applicable provincial or territorial legislation, including sale or disposal.

14) Mechanic's Lien

Black Sky Diesel reserves the right to retain possession of any vehicle or equipment until all charges for parts, labour, storage, and related fees are paid in full, in accordance with applicable lien legislation. This right is in addition to any other remedies available at law.

15) Intellectual Property and Site Use

All website content, branding, designs, text, media, and software elements are owned by or licensed to Black Sky Diesel and may not be copied, resold, scraped, reverse engineered, or used for unlawful purposes without written permission.

16) Prohibited Conduct

  • Fraudulent transactions, false identity, chargeback abuse, or unauthorized access attempts.
  • Interference with website availability, security controls, APIs, or service infrastructure.
  • Submitting harmful content, malware, or data intended to disrupt operations.
  • Using our services in violation of applicable laws or third-party rights.

17) Limitation of Liability

To the fullest extent permitted by law, Black Sky Diesel is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, downtime, loss of use, or business interruption. Our total liability for any claim relating to products or services is limited to the amount paid for the applicable product or service giving rise to the claim.

18) Indemnity

You agree to indemnify and hold harmless Black Sky Diesel from claims, losses, liabilities, and costs arising out of your misuse of the site/services, violation of these terms, or violation of law or third-party rights.

19) Governing Law and Disputes

These terms are governed by the laws of the province/territory in which Black Sky Diesel operates and applicable federal laws of Canada. Disputes are subject to the exclusive courts of that jurisdiction, unless otherwise required by applicable consumer protection law.

20) Changes to Terms

We may update these terms from time to time. Updated terms are effective when posted at /terms with a revised date. Continued use of our website or services after updates means you accept the revised terms.

These Terms of Service do not limit non-waivable rights provided under applicable consumer protection law.
